Welcome to JAMS and JAMS Access, our secure online case management website used to streamline the filing and service of documents and facilitate communication within your cases (the “Services”) located at Access.JAMSADR.com (the “Site”). This Privacy Notice explains how our organization uses the personal data we collect from you when you use JAMS Access; your rights under the California Consumer Privacy Act (“CCPA”) and the UK & EEA General Data Protection Regulation (“GDPR”); and includes the JAMS Access Cookie Notice at the end.

What data do we collect?

Our Company collects the following categories of personal data from you, limited to the bare minimum necessary, when you register for and use JAMS Access:

How we use your data

Data protection law means that we can only use your data for certain reasons and where we have a legal basis to do so.

Contract: the processing is necessary for the performance of a contract to which you are party, or to take steps at your request before to entering into a contract.

JAMS Access processes your data to provide the Services to you pursuant to our contract with you, allowing you to:

File all case documents with JAMS
Serve documents on other counsel, when appropriate
Access all uploaded documents remotely
Export all uploaded documents to your local computer
View case calendar case events
Communicate over a message board with Neutrals, Counsel, and other parties
Receive Emails, Messaging Chats, and Alerts & Notifications
Create Summary or Digest Notifications
View statements and pay invoices directly within the portal

Legal obligation: the processing is necessary for JAMS to comply with the law (not including contractual obligations).

In some cases, JAMS Access may process your data to comply with applicable law, legal process, or regulation; protect any person from death or serious bodily injury; or to carry out a task in the public interest.

How we share your data

Your data is shared only when strictly necessary and according to the safeguards and good practices detailed in this Privacy Notice. We do not share your personal data with others except with our authorized service providers that perform certain Services on our behalf. Unless we tell you otherwise, our service providers may only use data we share with them in in accordance with our writing agreement with them. These Services may include processing payments and supporting our website functionality.

We may disclose your information in response to a subpoena or similar investigative demand, a court order, or a request for cooperation from law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law.

In connection with a substantial corporate transaction, such as the possible sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

How we store your data

The Services are provided from the United States. By using and accessing the Services, you understand and agree to the storage of Content and any other personal information in the United States.

How long we retain your data

We will keep your information until you close your JAMS Access account, which must be done by contacting us directly using the methods below or by reaching out to your JAMS Associate.

All confidential case documents will be deleted 90 days after the case is closed.

How do we protect your data?

JAMS is committed to securing your personal data. We take appropriate technological and organizational measures to help protect your personal information from loss, theft, misuse and unauthorized access, disclosure, alteration, and destruction. JAMS complies with applicable data protection, privacy, and security breach notification laws, including adhering to CCPA, GDPR, and HIPAA best practices.

However, no server, computer or communications network or system, or data transmission over the Internet, can be guaranteed to be 100% secure. As a result, we cannot guarantee the security of any information you transmit to us or through the use of the Site or any of the Services.

Some of the ways in which JAMS protects your personal information include:

We encrypt your data when it is stored at rest and during transmission over the public Internet with industry leading encryption protocols.
We keep the servers on which personal information is stored in a controlled environment with limited access.

JAMS does not sell any personal data collected as part of JAMS Access Services.

You may make a verifiable request to exercise the following rights, free of charge to you, twice in a 12-month period, and we are obligated to respond within a period of 45 days.
